Virginia ABC stores

Virginia ABC is governed by a three-person Board consisting of a Chairperson and two Commissioners who direct all agency operations. Board members are full-time state employees appointed by the Governor. The Board is ultimately responsible to the Governor and the people of Virginia for the operation of the Commonwealth’s system of alcoholic beverage control.

The Board is vested with the power to control the possession, sale, transportation and delivery of alcoholic beverages within the Commonwealth, and to establish and operate stores for the sale of distilled spirits. These powers are granted to the Board as a unit, not to any individual member. The Board has authorized Virginia ABC’s Chief Operating Officer to manage day-to-day operations at the agency.

Virginia ABC Board members serve as administrative-law judges for appeal hearings related to disciplinary matters involving licensees, contested ABC license applications and matters involving the beer and wine franchise acts. In this role, they conduct hearings, issue subpoenas requiring attendance of witnesses and the production of records, administer oaths and hear testimony.

The Board's authority includes final approval for executing leases, listing products for sale in ABC stores, submitting fund requests for agency appropriations and forecasting financial performance. The Board is required to submit an annual report to the Governor and General Assembly as well as submit a wine liter and malt beverage tax collections report to the Chairman of the House Appropriations Committee, Senate Finance Committee and the Virginia Wine Board each year.


Jeffrey Painter was designated Chairman of the Virginia Department of Alcoholic Beverage Control by Governor Terry McAuliffe in April 2014 after serving as Commissioner since January 2014. Painter has more than 20 years of senior executive leadership experience in the public and private sectors, including serving at the Virginia Department of Alcoholic Beverage Control as Legislative and Regulatory Coordinator from 2006–2008 and Chief Administrative Officer from 2008–2010. His other service includes Executive Director of the Virginia League of Conservation Voters and owner of Property Partners, a small business managing and investing in vacation properties. A native of Page County, Painter graduated from Emory and Henry College.

Judy Napier was appointed Commissioner of the Virginia Department of Alcoholic Beverage Control by Governor Terry McAuliffe in January 2014. Napier most recently served as Director of Business Development for the information technology firm CGI Group's Virginia sector. Before that she served as Assistant Secretary and Deputy Secretary of Technology in the administrations of Governors Mark Warner and Tim Kaine. She is a native of Portsmouth and graduated from Old Dominion University.

Henry L. Marsh III was appointed Commissioner of the Virginia Department of Alcoholic Beverage Control by Governor Terry McAuliffe in July 2014. Marsh was elected to the Senate of Virginia in 1991 and served until 2014, representing the cities of Petersburg and Richmond as well as Dinwiddie, Chesterfield and Prince George counties. He was also elected as the first African-American mayor of Richmond in 1977. A native of Richmond, he graduated from Virginia Union University and the Howard University School of Law.
